Update on Bivens v. Sanford case.

Proposition 64 continues to wreak havoc on my portfolio of cases involving both affected and unaffected plaintiffs; the price I pay for pleading a 17200 violation.

This week, Judge Goodman, accepting the arguments of the defendants' attorneys Greg Long, and Chad Levy and -- dismissed Webster Bivens claims brought under the former unfair competition law against Sanford and Costco.

Judge Goodman ruled that because the case lacked a plaintiff that had been injured, it was to be dismissed. We were not allowed to substitute in another plaintiff.

An ignominious end to a case that arose from Sanford's practice of shipping less product than their packaging indicated.

But, is it really the end.....
